Jane Doe’s mother alleged that from birth to the present, Jane Doe’s daughter primarily resided with her and that she functioned as the child’s sole caregiver. She further alleged that Jane Doe and the child’s father permitted her to act as the primary custodian.

Jane Doe’s mother reported that Jane Doe made multiple calls to law enforcement alleging attempted break-ins involving tampering with door locks. She also reported that Jane Doe contacted police regarding an object described as a “sex toy bunny flashlight with a remote control” found under Jane Doe’s daughter’s bed. Law enforcement reportedly investigated and found a plain stuffed rabbit.

Jane Doe’s mother reported concerns regarding Jane Doe’s behavior, including allegations of paranoia. She stated that Jane Doe accused her stepfather of spying on her through cameras hidden in night lights, although no cameras were found in the home. Jane Doe’s mother further alleged that Jane Doe accused the stepfather of coordinating with an individual in New York to surveil her; it was later determined that the stepfather was communicating with his own mother, who resides in Montana.

Jane Doe’s mother reported that Jane Doe contacted her sister stating that her life was in immediate danger. Jane Doe’s mother reported that upon checking on her, Jane Doe appeared to believe there was a recording device in the room. Jane Doe’s daughter was evaluated by her pediatrician and at a local children’s hospital, and no signs of sexual or physical abuse were identified.

Additional allegations included that Jane Doe did not consistently bathe or change her daughter’s clothing, allowed frequent preschool absences, kept the child up late at night, and that the child appeared fatigued when brought to school. Jane Doe’s mother also reported concerns regarding Jane Doe’s access to transportation and alleged that Jane Doe planned to reside with her father upon release, whom she stated lacked adequate space for both Jane Doe and the child.

Jane Doe’s mother requested that the Court grant her both temporary and permanent custody of Jane Doe’s daughter, including immediate custody and restrictions preventing Jane Doe from removing the child from the Court’s jurisdiction.

Following approximately two months of investigation, the Court dissolved the order. The allegations were determined to be unfounded, baseless, in other words, they were false allegations.

All prior allegations were investigated and ruled unfounded. In 2022, it was alleged that Jane Doe contacted her child’s paternal grandmother stating that her daughter was ill and required medication. While detailed information regarding the initial phone call is unavailable, the text message communication was reviewed and is summarized below:

The paternal grandmother reported speaking with Jane Doe’s mother, who stated she was willing to assist financially but only by paying the provider directly and requested that Jane Doe contact the her and her step father with a decision. Jane Doe responded that this arrangement was expected and declined the assistance. Two days later, Jane Doe reported that she had spoken with a physician and obtained the prescribed medication. The communication indicated that Jane Doe’s daughter was improving and that her symptoms were resolving. The paternal grandmother expressed relief regarding the child’s improvement.

Jane Doe reported that this interaction, along with multiple other attempts at communication, were initiated by Jane Doe’s mother or were otherwise used as efforts to reestablish contact.

Jane Doe reported continued distress related to these interactions. During this period, Jane Doe’s daughter received counseling services through her local public school. A summary provided by the school counselor indicated that Jane Doe’s daughter demonstrated significant improvement in emotional regulation, social engagement, and classroom functioning. The counselor reported that Jane Doe’s daughter was interacting appropriately with peers, making friends, and showing increased comfort in the school environment.

The counselor indicated that individual counseling sessions were no longer necessary at that time but stated that periodic check-ins would continue to monitor progress and classroom adjustment. No referral for additional therapeutic services was recommended. The counselor also reported implementing a simple emotional communication tool in the classroom to support Jane Doe’s daughter in expressing feelings and managing anxiety related to school tasks.

The counselor expressed appreciation for the opportunity to work with Jane Doe’s daughter and noted positive overall progress.:

DSS received a report concerning Jane Doe and her daughter. A deputy from the Sheriff’s Office was dispatched to Jane Doe’s apartment after neighbors reported hearing the mother screaming and yelling at the child. The reporting party stated that Jane Doe was heard yelling, “I wish you were never born.” The deputy reported that Jane Doe did not answer the door.

Later that afternoon, representatives from DSS and FSS made an unannounced visit to the apartment; no one answered the door. DSS and FSS then went to the apartment complex office to confirm the tenant information but were informed that the property manager would not be available until 07/18/23.

FSS contacted the apartment complex manager and confirmed that the tenants of the apartment were Jane Doe and her daughter.

FSS and an investigator from the Sheriff’s Office made contact with Jane Doe and her daughter at the apartment. Jane Doe was described as short and abrupt in her responses. She was wearing headphones and stated that she was hard of hearing due to a prior injury.

Jane Doe’s daughter was present at the door. Jane Doe did not allow FSS or the investigator to enter the apartment; however, the living room was visible from the doorway and appeared to have minimal furnishings.

FSS informed Jane Doe that the agency had received a report regarding screaming and yelling coming from the apartment and that concerns had been raised about the child’s welfare. Jane Doe stated that she had been yelling at a medical transportation provider over the phone after a last-minute cancellation, as she needed transportation for her daughter’s medical appointment. She reported that she “lost it” while speaking to the company.

Jane Doe was observed to speak very rapidly, shift topics frequently, and demonstrate difficulty maintaining focus, making it challenging to follow her narrative.

Jane Doe requested that FSS and the investigator return later in the day, stating that she goes to bed early and that her daughter had schoolwork to complete. Jane Doe then closed the door.

FSS observed that Jane Doe’s daughter appeared small for her reported age of six years. The child did not speak, avoided eye contact, and repeatedly looked down at the floor.

The investigator reviewed a call in which Jane Doe contacted the Sheriff’s Department in a distressed state, reporting that she lacked transportation to obtain groceries for her daughter. A master deputy contacted the on-call DSS worker and advised that a worker would follow up the next morning. In the interim, the deputy transported Jane Doe and her daughter to Walmart and assisted them in obtaining groceries.

FSS and the investigator conducted another unannounced visit to the apartment; no one answered the door. The investigator contacted Jane Doe by phone. Jane Doe stated abruptly that she was driving in the rain and could not talk, indicated she would need to contact the Sheriff’s Department to schedule a time to meet, and ended the call.

It was later determined that Jane Doe and her daughter were with a representative from a domestic violence shelter (DVS) at the bank. FSS and the investigator waited at the apartment until they returned. Upon arrival, Jane Doe, her daughter, and the DVS worker allowed FSS and the investigator to enter the apartment.

During the visit, Jane Doe was observed to display paranoid behaviors. She spoke rapidly and made statements indicating concerns that her computer was recording her and that her phone was listening to her.

Jane Doe’s daughter was observed to be extremely fatigued, repeatedly falling asleep while seated at the kitchen counter and struggling to keep her eyes open.

The DVS worker expressed significant concern for the child, stating that the child rarely speaks, does not smile, and frequently appears excessively tired.

After leaving the residence, the investigator contacted the DVS worker, who reported that Jane Doe’s daughter became highly distressed and began exhibiting signs of a panic response when the DVS worker offered to transport Jane Doe and her daughter to a medical appointment following the visit by FSS and the investigator. The DVS worker reported that Jane Doe declined the offer. The DVS worker further stated that Jane Doe reported her daughter had been upset earlier due to not wanting to leave the house and that Jane Doe administered Motrin to the child in an effort to calm her.

FSS and the investigator conducted another unannounced visit to the apartment. Jane Doe opened the door abruptly and appeared hostile. She refused to allow FSS and the investigator to enter the residence and instructed them to call prior to any future visits. Jane Doe used her cell phone to take a photograph of herself with FSS and the investigator, stating she wanted documentation of the visit. Jane Doe requested that they leave, stating she was scheduled to meet with the DVS worker to obtain groceries.

08/09/23

FSS and a supervisor staffed the case. Based on the totality of concerns, a decision was made for DSS to assume emergency custody of Jane Doe’s daughter.

No reasonable efforts to prevent removal were deemed to have been made.

Jane Doe’s sister reports that living with Jane Doe’s mother and witnessing what she describes as a destructive parenting style toward Jane Doe’s daughter has been extremely damaging to her mental health. She stated that although she did not want to leave, she felt unable to show up for anyone while Jane Doe’s mother remained actively involved in her life. Jane Doe’s sister described Jane Doe’s mother as a covert narcissist and reported that living with Jane Doe’s mother and stepfather made her feel as though she was “going crazy.”

Jane Doe’s sister further alleged that Jane Doe’s mother has a severe mental illness that she believes others do not fully understand. She expressed significant distress regarding the current custody dispute, stating that Jane Doe’s mother pursued custody of Jane Doe’s daughter in a malicious manner. Jane Doe’s sister warned strongly against allowing Jane Doe’s mother to obtain custody, stating, “Don’t let her win.”
